Thinking of buying a property in Bermuda?

There are guidelines for buying property on the Island of Bermuda based on whether a person is a Bermudian or non Bermudian / International buyer i.e. US Citizen, UK Citizen, etc.

· International buyers may only buy property in Bermuda that is currently owned by a non-Bermudian.

· Prospective international buyers must submit an application to the Bermuda Government for the grant of the license to hold property along with a fee.

· The cost of a Bermuda License to Acquire Property is 18 percent of the purchase price of a condominium and 25 percent of the purchase price of a house.

· A property's annual rental value (ARV) must exceed a designated amount ($32,400 for a condominium, $153,000 for a house) to be eligible for purchase by an international buyer.

· International buyers may not buy investment property such as land, commercial real estate or property intended mainly to earn rental income.

"Tenants in Common" vs "Joint Tenancy"

If you intend to purchase your property together with another person in Bermuda you will be asked to decide whether you wish to purchase as Tenants in Common or buy the property in Joint Tenancy.

Simply put, if you are buying as Tenants-in-Common each person owns a share of the property and can give/bequeath their share to another person.

Buying as Joint Tenants you buy a property with one or more people subject to the law of survivorship.  If one person dies the property is automatically owned by the remaining people. No person has a specific interest in the property, they all own it equally together.

The buying process in Bermuda

How do I go about buying a property in Bermuda? 
  1. Visit a bank or lending institution and get pre approved for a mortgage.  You do this by making an appointment with a loan officer and providing them accurate information on your income and expenses so that they can work out how much they will lend you. 
  2. Choose a realtor  and go and meet with them to discuss what you are looking for, where you would like to live as well as what your needs are and what your wants are.  Make sure you like and trust them. They will be able to give you information of likely properties and help you and save you time by filtering out the properties that look and sound right but don't fit the description of what you are looking for.
  3. Once you have visited a property that you like and decide it is the one for you, make a written offer on the property with the help of your realtor.  This is important because it is a record of intent and stops confusion later on. It also clarifies the terms and conditions (not just the amount) under which you intend to purchase the property and here again take the advice of your realtor as to what you should consider including in your offer.
  4. Your realtor can provide you with an idea of what the closing costs on your offer will be and these should be calculated with your offer price and fall within your pre-approved mortgage amount.
  5. Once your offer is accepted, contracts for the purchase of the property will be drawn up and will be sent to your lawyer for approval and you will be asked to organise a 10% deposit for when you sign the contract.
  6. Your lawyer will review the contract details with you and if you are in agreement you will make an appointment to sign the agreement and lodge your deposit.
  7. Once both parties have signed the Sale and Purchase Agreement and the purchaser has lodged the deposit you are said to be in contract and neither party can withdraw unless certain conditions are not met.
  8. From here it takes about 30 days for a planning search and then you can complete the sale provided all the other conditions are met. Depending on what they are it can take different lengths of time.
  9. At completion the mortgage proceeds are sent to your lawyer and then on to the vendors lawyer after any outstanding debts such as Land Tax are paid. The conveyance document is signed by the vendor  and returned to your lawyer completing the sale and you become the new owner of the property.

Get the most out of your real estate agent in Bermuda.

When you choose a Realtor it is important that you spend time talking to them.  Make an appointment with your real estate agent before you go and look at properties - meet with them to discuss what you are looking for.

Your real estate agent should know where you would like to live, as well as what your needs are and what your wants are.  Needs are what you have to have and wants are things that you would like to have but could be negotiable on. You need to trust your agent and give them this information.

They can really help you by saving you time and effort by filtering out the properties that look and sound right but don't really fit the description of what you are looking for. They will be able to give you all kinds of information on likely properties and comparables to help you through the offer process.

There seems to be a lot of property on the market at present where people are looking to sell their own property and buy another - upgrading or downgrading.

Here I am with Kelly, artwork in the background enjoying the ambience of The Plaza Cafe (old Rudi's cafe in Walker arcade). Many people were staying for dinner and that looked very good too.

Plaza Cafe - a great new restaurant and bar - Walker Arcade, Bermuda

Are you looking for something different to do on a Friday evening after work?  Why not do happy hour at the Plaza Cafe  in the Walker Arcade (used to be Rudi's cafe).
 
Kelly and Donte Hunt have done an absolutely brilliant job on updating and renovating it.  They have opened it up inside with mirrors and bright artwork.  The high ceiling is acentuated by textured wood beams and I loved the new counters, lighting and display shelving.  It works equally well as a bar at night and a restaurant in the day. 

The drinks tasted great, were reasonably priced and the waiters were friendly. Kelly say that it is a brilliant venue for a party and encourages private functions which can take advantage of their outside plaza setting in the arcade.

Weather related

Hooray the sun came out! I'm not accustomed to ongoing bad weather.  It seems like months since we had a straight week of sunshine without wind or showers and I know that I 'm getting older but I don't remember it being like this in previous years.

On the way back from St Georges today I stopped near Shelly Bay to take a picture of the white caps and swell on the sea and was totally soaked in salt spray within a few minutes.  The colour of the water was still clean turquoise and there was a windsurfer riding the waves.  I can't think what possesses people to go into the water in weather like this!
